Typically, it is the parent or guardian of the child who is responsible for making the injury claim. This person is known as a 'litigation friend' and they'll be in charge of the following:
- Making decisions in the child's best interests
- Keeping the child up to date with the case and finding out their wishes
- Talking to the solicitor for updates and giving instructions in the child's best interests
The litigation friend will be responsible until the claim is resolved or the child turns 18 and can handle the proceedings themselves.

Anyone under the age of 18 won't be able to access the compensation until their 18th birthday. The money will instead be invested by the Court Funds Office until they can legally claim it.
Some judges may decide to pay out smaller amounts if they believe that it will benefit the child to do so. This could be for medical treatment, modifications to a home or to support the child's education during recovery.

Once their 18th birthday comes around, the three-year limit will come into effect, which means that they can claim for the injury sustained as a child up to the age of 21.
However, if the child becomes an adult but does not have the mental capacity to bring a claim themselves at that stage, then the litigation friend will have unlimited time to act on their behalf. Should their mental capacity return, then the three-year limit will once again begin.
