The result is that compensation for small personal injury claims - such as for soft tissue or whiplash injuries - are now fixed, banded by severity, and lower than they once were. As of March 2022, the government shelved plans for further reform.

On 31st May 2021, the rules for making small personal injury claims following a road traffic accident changed. A government tariff for whiplash claims was introduced to link compensation awards to the length of time the injury lasts. These updates are designed to decrease the number and costs of fraudulent claims and could reduce motor insurance prices for drivers and road users. These updates mean:
- The small claims general damages limit will rise for road traffic accident injuries from £1,000 to £5,000.
- Compensation for soft tissue and whiplash injury claims is now fixed, banded by severity, and lower than before.
- People can no longer recover their legal costs from the other side in a small claim. These will now be deducted from compensation awards up to £5,000.'
- Some other minor road traffic accident injuries - like simple fractures - are now classed as a small claim.
- People now have the option to make a small road traffic accident claim themselves online, without needing help from a solicitor.
These rules are not applicable if you are a vulnerable road user (pedestrian, cyclist, etc.) involved in the accident and your claim will be unaffected by these updates. Other small personal injury claims remain unaffected by these updates such as medical negligence claims, public accidents, and workplace accidents.

Yes, absolutely. If you're injured in a road accident as a driver, rider, passenger, cyclist or pedestrian, always report it to the police as soon as you can (and your motor insurance company if you were the driver or rider).
Make sure you also report it to your GP (particularly if you needed a visit to A&E). For injuries from trips, slips and falls in public, make sure you see your GP and inform the body responsible in writing - this could be the local council, a local business, a property landlord or even your employer. If it's a claim for historical injuries then there's no need to report it to the police.
As soon as is practical, start recording the evidence. Take several good quality close-up photographs of your injuries from different angles, especially if they're to the face. Remember to photograph the scene of the incident too: get pictures of the defect, hazard or road layout and also images of the wider area that show its state of repair.
Don't forget to check if there's a CCTV camera in range - if there's footage, it could be invaluable for supporting your case.
